Text (English translation)1381. Aug. 7. Reading. On the petition of Thomas bishop of Ely showing that, whereas among other liberties and privileges granted to his predecessors by charters of the king's progenitors which the king has confirmed it was granted that his said predecessors and their successors should take and have year, waste and chattels of felons, fugitives and condemned persons, and all other forfeitures which might pertain to the king within the isle of Ely and the other lordships of the bishopric, both those of the men and tenants of the bishop and the bishop's own fee and those of the men and tenants of other persons and the fee of other persons, and that no justices in eyre or other justices of the king or his heirs, nor any sheriffs, coroners or other ministers of the king or his heirs, nor any township, should intermeddle therein at all, and whereas now divers tenants of the bishopric, who lately were insurgent together with other malefactors against their allegiance, are convicted of divers treasons and misdeeds and adjudged to death, so it is that the lands and goods of such convicted persons are taken into the king's hand by the escheator in the county of Cambridge in contravention of the charters aforesaid; the king, lest any damage, prejudice or inconvenience accrue to him or to the said bishop, and because Richard earl of Arundel has mainperned before the king and the council to answer to the king for the issues of the lands of such convicted persons and the true value of their goods, if it be adjudged that the lands and goods ought to pertain to the king, and to answer to the bishop therefor if they be adjudged to him, has committed to the said earl the keeping of all the lands and goods of any men condemned for the above cause within the isle of Ely and the lordships aforesaid, together with the issues thereof since they were taken into the king's hand, to hold the same until it be adjudged whether they ought to pertain to the king or to the bishop, provided that he answer to the king or the bishop in accordance with what shall be awarded in the next Parliament, and keep the lands without waste and destruction.
