Text (English translation)Cornwall. Concerning Margery, who was wife of William Basset, and Thomas Cotesford, executor of the same William, required to deliver the estreats for the aforesaid William, etc. It was ascertained in the originalia of 5 Rich. II [1381‒2] etc., that the same lord King, because a great many criminals, in diverse associations and covenants, in diverse parts of our kingdom of England, against the loyalty and allegiance owed by the traitors to their said King, inimically made and perpetrated diverse treasons, murders, arsons, and other intolerable and unprecedented wrongs in the recent uprising, etc., the same lord King, from the advice and agreement of the peers and magnates aiding the lord King in the then last parliament, wishing the peace of his people be stabilized and strengthened etc, appointed, through his letters patent under his great seal dated 8 March 5 Rich. II [1382], his beloved Thomas, bishop of Exeter, Edward, earl of Devon, Robert Tresilian, Richard Sergeaux, John Kentwode, Ralph Cariminow, William Basset, William Bruyn, Thomas Peverell, William Talbot, Nicholas Wanniford, Otho Bodrygen, John Sergeaux and John Tremayn, jointly and severally, of whom some of the aforesaid, Robert [Tresilian] and John Tremayn was a justice, for the peace of the said King in the county of Cornwall etc. [an extensive description of their commission follows]. Margaret, who was wife of the aforesaid William Basset, whom the sheriff of Cornwall returned as executor of the aforesaid William at the quindene of Hillary this term [27 January‒2 February 1385], because the same William died, just as at the quindene of Easter 7 Rich. II [25 April‒1 May 1384] and octave of Saint John the Baptist last [1‒7 July 1384], the same Thomas [Cotesford] was summoned by the bishop of Exeter, because is a cleric and holder of a benefice in the diocese of Exeter, and has no lay fief in said county of Cornwall whereby he was able to be distrained, to be here at the aforesaid quindene of Hillary this term, to deliver for the aforesaid William Basset, as well as for the other justices aforesaid, the estreats of the sessions of the justices aforesaid, just as said sheriff of Cornwall returned to this exchequer at the quindene of Michaelmas last [13‒19 October 1384]. At the aforesaid quindene of Hillary, the aforesaid Margaret, and Thomas de Cotesford, came here, Margaret through John de Castleton, her attorney, and the aforesaid Thomas de Cotesford in person. The aforesaid Margaret does not deny that she is herself executor of the aforesaid William Basset and holder of a parcel of land and a tenement which belonged to the same William. The aforesaid Thomas de Cotesford states in protest that that he is not the executor of the aforesaid William Basset, but he acknowledges that he is himself a holder of a parcel of land and tenement which belonged to the aforesaid William; but the aforesaid Margaret and Thomas de Cotesford say that they themselves ought not deliver the estreats aforesaid, because ‒ they say ‒ that the letters patent aforesaid never arrived in the hand of the aforesaid William Basset, nor did the same William have any knowledge of the aforesaid letters, nor did the same William conduct any sessions under the pretext of the aforesaid letters, nor did any estreat arrive in the hand of the aforesaid William, during his life, and neither did any arrive in the hand of the aforesaid Margaret and Thomas de Cotesford after the death of the aforesaid William; and this they put forward to prove etc., they beg the same Margaret and Thomas be discharged regarding the aforesaid estreats. It is said for the king that the letters aforesaid arrived in the hand of the aforesaid William Basset, and that he himself had knowledge of the aforesaid letters, and that he himself conducted diverse sessions under the pretext of the aforesaid letters, and that diverse estreats arrived in the hands of the aforesaid William Basset, during his life, and also, furthermore, they arrived in the hand of the aforesaid Margaret, and Thomas de Cotisford, after his death. It is asked for the lord King that this be examined by a jury. And the aforesaid Margaret and Thomas de Cotisford say that which they said before, and they request similarly. Therefore, let inquiry be made, and it is ordered that the sheriff of Cornwall undertake this at the quindene of Easter [17‒23 April 1385] etc. And the same day is given to the aforesaid Margaret and Thomas de Cotisford etc. At which day the aforesaid Margaret, and Thomas de Cotesford came here, namely Margaret through John de Castleton, her attorney, and the aforesaid Thomas de Cotesford in person, and the sheriff did not return the writ. Therefore, it is ordered the sheriff undertake the like etc., at the quindene of Trinity [29 May‒4 June 1385], and the same day is given to the aforesaid Margaret and Thomas de Cotisford etc. At which day the aforesaid Margaret, and Thomas de Cotesford came here, namely Margaret through John de Castleton, her attorney, and the aforesaid Thomas de Cotesford in person, and the sheriff did not return the writ. Therefore, it is ordered the sheriff undertake the like etc., at the quindene of Michaelmas [13‒19 October 1385], and the same day is given to the aforesaid Margaret and Thomas de Cotisford etc.
