Text (English translation)Surrey. Thomas Crundall, clerk, was attached to answer John Peyntour, parson of Sutton, in a plea that with force and arms he broke the close and houses of the same John at Sutton and took and carried away his goods and chattels found there worth £40, and other enormities etc. at grave damage etc. and against the peace. And therefore the said John in his own person makes a complaint [before the court] that the said Thomas on Saturday after Corpus Christi 4 Richard II (15 June 1381) with force and arms, namely swords, clubs etc. broke the close and houses of the same John at Sutton and took and carried away his goods and chattels, namely woollen and linen cloths, brazen vessels, lead and timber, twelve quarter of threshed wheat, barley, beans and sheaves of oats, worth £40 ... and thus he says he suffered damages of £200 and thereupon he brings suit etc. And the aforesaid Thomas in his own person comes and defends the force and injury etc. [paraphrase:] Thomas claims that he has a bull from pope Urban bestowing on him certain benefices, owned by the Abbot of Chertsey, during the vacancy of the parsonage and that John was not rightfully ordained at the time of the alleged trespass, i.e. Thomas took only what was rightfully his. John claims that he was the rightful parson at the time of trespass. Both are prepared to put themselves on the country. A day is given to appear before the king's bench in the quindene of Easter, but the sheriff did not summon the jury, therefore the case was postponed until the eve of Ascension Day.
General InformationCf. CCR 1381-85, p. 129: order to release John Peyntour, parson of Sutton, from Guildford gaol where he was imprisoned at suit of Thomas Croundale, clerk. Dated 6 Feb 1382.
