Text (English translation)Norfolk. Sir Roger Bacone is in mercy for multiple defaults. The same Roger attached to answer Hugh Fastolf on a plea that together with Roger Gogone of Ditchingham, Adam Ade of Ditchingham, Henry Fayrman of Lingwood, Robert Gardyner of Halvergate, John Skot, Geoffrey atte Cherche, John atte Cherche, Thomas Lote, Richard Grannt, John Fullore, Thomas Thirald, John atte Chambre of Potter Heigham, Peter Iokkes of Potter Heigham, Richard atte Welle of Ludham, Adam Chibbe of Stalham and John Soutere de Stalham with force and arms they broke the close and houses of the said Hugh in the town of Great Yarmouth and took and carried away his goods and chattels found there to the value of £40 and inflicted other enormities on him, to the grave damage of the said Hugh and against the King's peace. And whence the same Hugh complains through his attorney John Drake that on Tuesday 18 June 1381 the aforesaid Roger, with force and arms, namely swords, bows and arrows, broke the close and houses of the said Hugh in the town of Great Yarmouth and took and carried away his goods and chattels found there, namely woollen and linen cloth, silver plate, mazer cups, bronze, gold and silver vessels, and other necessaries of the home found in the same, and other enormities, to the grave damage, against the peace, whence he says that he suffered damages to the value of £100, and thereof he produces suit. The aforesaid Roger Bacone appears through his attorney and says that he is not guilty of the aforesaid trespass and places himself on the country. And the aforesaid Hugh likewise. Therefore, the sheriff is ordered to summon twelve jurors for the octave of Hilary 1383. Afterwards this was delayed until the quindene of Trinity next, unless the justices of our lord King are assigned to hold assizes in the aforesaid county. They had appeared before Thursday in the week of Pentecost at Norwich, and lately on this day the aforesaid Hugh appeared through his attorney. And the aforesaid justices have sent here their record in these words: Afterwards, on the day and at the place contained within, before John Holt and William Thirnyng, justices of the lord King, assigned to hold the assizes in the county of Norfolk, according to the form of the statute, and the Hugh Fastolf named within appears through his stated attorney. And the Sir Roger Bacon named within, solemnly summoned, does not come. Therefore, let the aforesaid jury be taken against him by his default. And hereupon the jurors summoned came, who, from agreement of the aforesaid Hugh Fastolf, elected, tried, and sworn to this, say on their oath that the aforesaid Roger Bacone is guilty of the aforesaid trespass and they uphold the damages of the said Hugh on the occasion of the trespass to 100m. Therefore, it is considered that the aforesaid Hugh should recover damages to the 100m assessed from the aforesaid Roger Bacon, and should thenceforth have execution against the same Roger, for the reason that the said Hugh declines to prosecute his aforesaid writ against the aforesaid Roger Gogone and the others contained in the same writ present here in court. And the aforesaid Roger should be arrested.
