Et vnde idem Walter fitz Wauter per Iohannem Giffard attornatum suum queritur quod predicti Iohannes et Walterus Smyth simul et co. die iouis in festo Corporis Christi anno regnorum domini regis nunc quarto vi et armis scilicet gladiis arcubus et sagittis clausum ipsius Walteri fitz Wauter apud Reyndon et Sheryng fregerunt et rotulos videlicet curiae suarum de maneria predicta pertinencia et cartas virtute quarum quod tenet maneria predicta et plures alia diuersa terras et tenementa in comitatu predicto ac duodecim scripta per que diuersi homines eidem Walteri fitz Wauter in diuersis pecuniarum summis obligati fuerunt ac alia munimenta videlicet diuersos libros et rotulos ac custumarios in quibus opera et custume ad maneria sua de Reyndon et Sheryng et alia maneria et tenementa sua in comitatu predicto debita et pertinencia ac quantitatis et parcelle terrarum et tenementis maneriorum predictorum separatim scripta specificata et declarata fuerunt ibidem combusserunt et in homines et seruientes suos videlicet Iohannem atte Welle et Willelmum Sharnebrok ibidem insultum fecerunt et ipsos verbauerunt vulnerauerunt et male tractauerunt per quod idem Walterus seruicium eodem hominum et seruientum suorum per magnum tempus videlicet per unum quartum anni amisit et alia enormia et co. Et predicti Iohannes et Walterus Smyth in propria personis suis venerunt. Et defenderunt vim et iniuriam quando. Et dicunt quod ipsi in nullo sunt culpabiles de transgressione predicta prout idem Walterus fitz Wauter superius versus eos queritur. Et de hoc ponunt se super patriam. Et predictus Walterus fitz Wauter similiter. Ideo preceptum est vicecomiti quod venire facias hic a die sancti Michaelis in xv dies per iusticiaros xij et co per quos et co. ad recognoscendum et co. Quia tam et co. Idem Walterus fitz Wauter per predictum attornatum suum optulit se quarto die versus predictus Iohannem Baldewene Willelmum Ricardum Iohannem Shepherd Ricardum Iohannem Grigge et Iohannem Cowyk de predicto placito. Et ipsi non venerunt. Et preceptum fuit vicecomiti quod attachieret eos et co. Et vicecomes modo mandat quod nichil habent et co. Ideo preceptum est vicecomiti quod capiat eos et co et co Et saluo. Ita quod habeat corpora eorum hic ad prefatum terminum et co.
Text (English translation)Essex. John Beverle of Cheshunt and Walter Smyth of Waltham Holy Cross were attached to answer Walter Fitzwalter that together with John Baldewene, William atte Hell, Richard Bokkeng, John Shepherd of Roydon, Richard Croucheman, John Grigge and John Cowyk junior of Sheering with force and arms they broke the close of Walter Fitzwalter at Roydon and Sheering and burnt rolls charters and writings found there and assaulted his men and servants and beat and ill treated them so that the said Walter Fitzwalter lost the service of his men and servants for a great period of time. And Walter Fitzwalter by John Giffard his attorney complains that the said John and Walter Smyth together et co. on 13 June 1381 with force and arms namely with swords bows and arrows broke the close of the said Walter Fitzwalter at Roydon and Sheering and burnt rolls namely of his courts pertaining to the said manor and charters by virtue of which he held the said manor and many other various lands and tenements in the said county with twelve writings by which various men were bound to pay the same Walter Fitzwalter various sums of money and oher muniments namely various books and rolls and custumaries in which works and customs owed and pertaining to his manors of Roydon and Sheering and other manors and tenements belonging to him in the said county with quantities and parcels of the lands and tenements of the said manors separately specified written and declared and assaulted his men and servants namely John atte Welle and William Sharnebrok and beat, wounded and ill treated them so that the said Walter lost the service of his men and servants for a great period of time namely one quarter of a year. And the said John and Walter Smyth come in person and say that they are not guilty of the said trespass. And they place themselves on the country. And the said Walter Fitzwalter likewise. Therefore the sheriff is ordered to summon jurors to come in the quindene of Michaelmas 1383. The same Walter Fitzwalter by his attorney appears against the said John Baldewene William Richard John Shepherd Richard John Grigge and John Cowyk on the said plea. And they do not come. Sheriff ordered to attach them. And the sheriff returns that they have nothing. Therefore the sheriff is ordered to arrest them to be in court in the said term.
