4057John Savage v. John de Gisburn on a plea of trespass by bill[John] de Gisburn, sometime mayor of York, in mercy for various defaults. The same John was attached to answer John Savage of York on a plea of trespass by bill. The same John Savage complains that the aforesaid John de Gisburn on [...] assaulted him at York with force and arms and detained him in prison under colour of his office for three weeks until he made a redemption with Gisburn of 20s, which Gisburn took against the peace and to the damage of Savage of £10. Gisburn comes by John Brett his attorney, and upon this comes John [...]ngton the mayor's attorney and bailiff of the city of York, who says that this plea should be held in the court of [...] in York by virtue of a charter of King John dated 2nd July 1378 [reproduced here] and also a writ dated 1st September 1382 directing justices to follow the tenor of the charter. He also refers the justices to the case between Richard del See and Henry Sharrow in Commons Plea 3 RII (referring them to roll 415). Savage's attorney denies this, but it is decided that the mayor and bailiffs should have jurisdiction of this case and a day for hearing in their court is fixed.
