Text (English translation) | Cambridgeshire Henry atte Brook of Elsworth was attached to answer to Margaret Mareschall, Countess of Norfolk, in a plea of why he, together with Thomas Chapman of Elsworth, attacked Edward Alderman, the same countess's servant, with force and arms at Elsworth, and beat, wounded and ill-treated him, because of which the same countess lost the service of her aforesaid servant for a great period of time, and inflicted other outrages on her, to the same countess's damage of ten pounds, and against the king's peace etc. And concerning this the same countess, through Henry Ondell her attorney, makes complaint that the aforesaid Henry, together etc. on the Sunday following the feast of Corpus Christi in the fourth year of the present lord king's reign, attacked Edward Alderman, the same countess's servant, at Elsworth with force and arms, that is with swords, bows and arrows, and beat, wounded and ill-treated him, because of which the same countess lost the service of her aforesaid servant for a great period of time, namely from the aforesaid Sunday for a month then following; and inflicted other outrages on her, to the damage of the same countess of forty pounds, and against the peace etc. On account of which she says that she is harmed and has damages to the value etc. And on this she brings suit etc. And the aforesaid Henry appears through John Godfrey his attorney. And he defends the force and harm when etc. And as for the coming with force and arms, or whatever is against the peace, he says that he is in no way guilty of this. And on this he puts himself on the country. And the aforesaid countess likewise. And as for the beating etc., he says that the aforesaid Edward, at the said day, year and place attacked the same Henry, and wished to have beaten him: because of which the same Henry defended himself as he was well permitted to do. Because of which he says that the harm that the same Edward then received was from his own attack and in defence of the same Henry's body; and this he is prepared to prove. Concerning which he requests judgment, if the aforesaid countess can assign injury on his person in this case etc. And the aforesaid countess says that she should not be barred from her aforesaid action by anything alleged above, because she says that the aforesaid Henry, of his own injury and without any reason alleged above, beat, wounded and ill-treated the aforesaid Edward, her servant, because of which she lost his service etc. for the aforesaid time, as she makes complaint above. And on this she puts herself on the country. And the aforesaid Henry likewise etc. Therefore the sheriff is ordered to have appear here, fifteen days after the day of Holy Trinity, twelve etc., by whom etc., and who do not etc., to investigate etc., because as much etc. |
