Text (English translation) | Middlesex: The jurors of diverse hundreds of the aforesaid county at another time, namely in the term of St Michael in the fifth year of the reign of the now king, before the lord king at Westminster, presented that Roger atte Wode of the county of Kent and others came in a great company of wrongdoers, insurgents of Kent, as the principal actor and leader, on the feast of Corpus Christi in the fourth year of the now king, at the Savoy in the county of Middlesex, and burnt down the said manor as an enemy of the king, and took a certain chest, in which there were £1,000 of sterling, of John, duke of Lancaster, and more there, and placed and carried away the said chest in a certain small ship upon the Thames, and brought it as far as Southwark, and there divided the said gold between themselves. And on the morrow, the said Roger and the other principal wrongdoers in the said company came to the house of St John of Jerusalem in England and put a fire there and fully burnt down the said house, and loaded two horses there with wool, worth six marks, and carried that away. And that the same Roger came at the Tower of London as the principal leader and thrust violent hands upon Simon, late archbishop of Canterbury, and brother Robert Hales, late prior of St John of Jerusalem in England, and dragged them out of the Tower of London and ordered them to be beheaded, viz on Friday next after the feast of Corpus Christi in the abovesaid year, and he made the aforesaid insurrections, burnings and felonies feloniously and traitorously on the aforesaid day and year, etc. By the records of the fifth year. By which the sheriff was ordered that he does not omit, etc, from taking the aforesaid Roger, if, etc. Afterwards the process thereof having been continued against the aforesaid Roger until Saturday next after the feast of St Martin in the fifth year of the reign of the now king. On which day the aforesaid Roger, on account that he did not come in the court of the king before the king to answer to the same king about the aforesaid felonies and treasons, he was placed in exigence to be outlawed, etc. And afterwards he was exacted from county to county until the county court of Middlesex, held at [blank] on Thursday next after the feast of the Annunciation of the Blessed Mary in the fifth year of the reign of the now king. On which day the aforesaid Roger, on account that he did not come in the king's court, etc, was outlawed in the aforesaid county. By which it is to be inquired into as his lands and chattels, etc. Afterwards, namely on Wednesday next after the octave of St Hilary in this same term, before the lord king at Westminster there came the aforesaid Roger atte Wode and he handed himself over to the prison of the marshal of the lord king by the aforesaid occasions, who is committed to the marshal. And immediately having been brought by the marshal, he came and was questioned as to if he has or knows anything to say for himself as to why it ought not to be proceeded to judgment about him upon the aforesaid outlawry. Who says that the lord now lord king, at the entreaty of his commonalty of his realm of England, and with the assent of the prelates, dukes, earls and barons of the same realm in his last Parliament, held at Westminster on Monday in the octave of St Michael last past, pardoned and remised to all and singular his liege subjects and inhabitants of the realm, etc, excepting, etc, the suit of his peace, which pertains to him for all kinds of treasons and felonies, howsoever made or perpetrated in the said insurrection, viz between the first day of May in the fourth year of his reign and the feast of the Nativity of St John the Baptist then next following, whereof they are indicted, charged or appealed, and also outlawries, if any, etc. And upon this he produces herein court a certain writ of the lord king of close, directed to the justices here, in these words: Richard, by the grace of God king of England and France, and lord of Ireland, to his beloved and faithful Robert Tresilian, his chief justice, assigned to hold pleas before us, greetings. Whereas, out of our special grace and at the entreaty of the commonalty of our realm of England, and with the assent of the prelates, dukes, earls and barons of the same realm in our last Parliament, assembled at Westminster on Monday in the octave of St Michael last past, we pardoned and remised to all and singular our subjects and inhabitants of the realm, of whatever status, grade or condition they may be, excepting all those, whose names, at another time in our Parliaments in the fifth and sixth years of our reign, were delivered to be excepted from all grace then made by us, as if, namely, the principal starters, abettors and procurers of the insurrection that lately had arisen within our aforesaid realm traitorously, whereof they are charged, and also to three other persons, citizens of London, who in our said last Parliament were also especially charged of certain articles and treasons, made in the said insurrection, and to all others being fully in the same case of the said three citizens or any one of the same men, and also to all and singular persons of the vill of Bury St Edmunds similarly excepted, the suit of our peace and whatever pertains to us or could pertain, for all kinds of treasons and felonies, howsoever made or perpetrated in the said insurrection, viz between the first day of May in the fourth year of our reign and the feast of the Nativity of St John the Baptist then next following, whereof they are indicted, charged or appealed, and also outlawries, if any have been published against them or any one of them by these occasions, and we have thereupon granted our firm peace to them and to each one of them. In such a way that they are to stand trial in our court, if anyone wishes to speak against them or any one of them about the premises or any of the premises, just as is more fully contained in the statute thereupon issued. We command you that you do not trouble or harm in any way Roger atte Wode of the county of Kent, if he is not one of the persons, whose names were delivered in our aforesaid Parliaments, contrary to the form of the aforesaid statute, grace and remise. Witnessed by me, myself, at Westminster on the 17th day of January in the sixth year of our reign. Which same writ is filed among the orders of this same year. Whereof the same Roger seeks that he withdraws by virtue of the aforesaid pardon and remise without day, etc. And the aforesaid writ having been seen and understood and also the roll, in which the names, which were excepted in the said Parliament, having been sent to the court here to make process thereupon, on account that the same Roger is not contained among the aforesaid names, therefore the same Roger by virtue of the aforesaid pardon and remise is to go thereupon without day, etc. [Margin]: Without day. |
