Text (English translation)Regarding John Gore and John Testwode, whom the sheriff of Wiltshire returned as executors for Philip FitzWaryn, lately a justice of the King appointed in 5 Rich. II [1381‒2] to investigate rebels, have risen against their faith and liege, required to deliver for the aforesaid Philip all estreats of the sessions of the justice aforesaid. It was ascertained in the originalia of 5 Rich. II [1381‒2] etc., that the same lord King, because a great many criminals, in diverse associations and covenants, in diverse parts of our kingdom of England, against the loyalty and allegiance owed by the traitors to their said King, inimically made and perpetrated diverse treasons, murders, arsons, and other intolerable and unprecedented wrongs in the recent uprising, etc., the same lord King, from the advice and agreement of the peers and magnates aiding the lord King in the then last parliament, wishing the peace of his people be stabilized and strengthened etc, appointed, through his letters patent under his great seal dated 8 March 5 Rich. II [1382], his beloved Ralph, bishop of Salisbury, Walter, abbot of Malmsbury, William de Monteactute, earl of Salisbury, Thomas West, Thomas Hungreford, John de Roches, John Danntesey, Ralph Cheyne, Robert Cherleton, Philip FitzWaryn, Humphrey de Stafford, Ralph de Norton, John Bydestone, Walter Clopton, Hugo Cheyne, Robert Cherleton, Nicholas Bonham, Thomas Arn, John Wykyn, William Werston, William Stourton, John Butley and the mayor of Salisbury at the time, jointly and severally, of whom some of the aforesaid, Walter Clopton and Robert was a justice for the peace of the said King in the county of Wiltshire etc. [an extensive description of their commission follows]. John Gore and John Testwode were returned as executors of the aforesaid Philip FitzWaryn at the morrow of the Purification of Mary 9 Rich. II [3 February 1386], because the same Phillip died, just as the aforesaid sheriff returned to this exchequer on the morrow of Michaelmas 9 Rich. II [30 September 1386], likewise John FitzWaryn who the said sheriff returned at the morrow of the Purification of Mary 9 Rich. II [3 February 1386] as heir of the aforesaid Philip, and Henry de la Ryvere, knight, and Constance, his wife, who said sheriff returned as holders of the lands and tenements which belonged to the aforesaid William, they were required to be here at the quindene of Hillary this term [27 January‒2 February 1387], to deliver for the aforesaid Philip, along with the other justices aforesaid, all estreats of their sessions etc. At the aforesaid quindene, the aforesaid John Gore and John Testwode, came through Walter Knolles, their attorney, and the aforesaid John FitzWaryn, Henry de la Ryvere and Constance, his wife, did not come. The aforesaid John Gore and John Testwode say for themselves that they ought not deliver any estreats of any sessions under the pretext of the letters of the King aforesaid for the aforesaid Philip FitzWaryn. Because, they say, that they are themselves not executors for the aforesaid Philip, nor administrators nor possessors of any goods nor chattels which belonged to the aforesaid Philip on the day he died etc. [...] They beg that the aforesaid John Gore and John Testwode be discharged regarding the estreats etc. It is said for the King that the aforesaid John Gore and John Testwode are executors of the aforesaid Philip etc., that diverse goods and chattels of his etc., to the value of 1000l. or more, at Stannton [Stanton, Wilts.] and elsewhere in the county of Wiltshire, came into their hand etc. [...] It is asked for the King that this be examined by a jury, and the aforesaid John Gore and John Testwode they that which they said before and ask similarly. Therefore, let inquiry thence be made. It is ordered that the sheriff of Wiltshire make this at the quindene of Easter [22‒28 April 1387] etc., and the same day is given to the aforesaid John Gore and John Testwode etc.
