Text (English translation)Concerning Richard Sergeaux, Thomas Peverell, William Talbot, Otho Bodrigan, and John Sergeaux, justices of the lord king, bound to deliver the estreats of the aforesaid justices regarding the latest uprising in the county of Cornwall. It was ascertained in the originalia of 5 Rich. II [1381‒2] etc., that the same lord King, because a great many criminals, in diverse associations and covenants, in diverse parts of our kingdom of England, against the loyalty and allegiance owed by the traitors to their said King, inimically made and perpetrated diverse treasons, murders, arsons, and other intolerable and unprecedented wrongs in the recent uprising, etc., the same lord King, from the advice and agreement of the peers and magnates aiding the lord King in the then last parliament, wishing the peace of his people be stabilized and strengthened etc, appointed, through his letters patent under his great seal dated 8 March 5 Rich. II [1382], his beloved Thomas, bishop of Exeter, Edward, earl of Devon, Robert Tresilian, Richard Sergeaux, John Kentwode, Ralph Cariminow, William Basset, William Bruyn, Thomas Peverell, William Talbot, Nicholas Wanniford, Otho Bodrygen, John Sergeaux and John Tremayn, jointly and severally, of whom some of the aforesaid, Robert [Tresilian] and John Tremayn was a justice, for the peace of the said King in the county of Cornwall etc. [an extensive description of their commission follows]. The aforesaid William Talbot, Otho Brodygan and John Sergeaux were required to be here at the quindene of Michaelmas [13‒19 October 1384] to deliver, together with aforesaid Richard Sergeaux and Thomas Peverell, likewise all the other justices aforesaid, all the estreats of their sessions. And at the aforesaid quinene of Michaelmas the aforesaid Richard Sergeaux, Thomas Peverell and William Talbot came, that is to say Richard Sergeaux and Thomas Peverell through John de Castelton, their attorney, and the aforesaid William Talbot through Nicholas Fitzherberd, his attorney. The aforesaid Otho Brodyngham and John Sergeaux did not come at the aforesaid quindene of Michaelmas but later, that is to say having gone into default, Otho came namely through the said Nicholas Fitzherberd, his attorney. The aforesaid Richard Sergeaux, Thomas Peverel, William Talbot, Otho Bordigan and John Sergeaux state that they ought not deliver any estreats regarding the premises, because, they say, that the letters patent aforesaid neither arrived in the hand of any of them, nor did they conduct any sessions on the pretext of the aforesaid letters, nor did they themselves have any knowledge of the letters aforesaid, nor did any escheats arrive in their hand. And this they put forward to prove etc. It is said for the King that the letters patent aforesaid did arrive in the hand of the aforesaid Richard Sergeaux, Thomas Peverell, William Talbot, Otho Brodigan, and John Sergeaux, and that they themselves conducted diverse session on the pretext of the letters aforesaid, and that they themselves have knowledge of the aforesaid letters, and diverse estreats of their sessions arrived in their hand. It is asked for the lord King that this be examined by a jury; and the aforesaid Richard Sergeaux, Thomas Peverell, William Talbot, Otho Brodigan, and John Sergeaux say that which they said before, and ask similarly etc. Therefore, let inquiry be made, and it is ordered that the sheriff of Cornwall undertake this at the quindene of Hillary [27 January‒2 February 1385] etc., and the same day is given to the aforesaid Richard Sergeaux, Thomas Peverell, William Talbot, Otho Brodigan, and John Sergeaux. And it is carried out towards all other justices aforesaid just as is contained in the writ.
