Text (English translation)Middlesex. Walter de Heston, Thomas Jurdon, Thomas Hik, John Hik senior, John Hik junior, John atte Style, William Weyland, William Olyn, John Wrong, William Longer of Hatton, William Cotrell of Stanwell, Thomas Alcote, John Stut of London, Richard Umfray, Richard Ruddok, John Wrokeman and John Bertlot were attached to answer Nocholas Est of Heston in a plea that they with force and arms broke his close and four chests of the said Nicholas and took and carried away his goods and chattels found there, worth £10, and other enormities etc. to the grave damage etc. and against the peace etc. And therefore the same Nicholas by Stephen de Fall, his attorney, impleaded that the aforesaid Walter and the others on Saturday after Corpus Christi 4 Richard II (15 June 1381) with force and arms, namely swords, clubs etc., broke his close and four chests of the said Nicholas and took and carried away his goods and chattels, namely woollen and linen cloths found there, worth £10, and they inflicted other enormities on him against the peace of the lord king and whereof he says that he suffers damage. And the damage he has is worth £20 and therefore he brings this suit etc. And the aforesaid Walter de Heston and the others in their own persons come and defend the force and injury whenever etc. and they say that in a statute enacted and agreed in 6 Richard II as to the quarrels or suits of trespass done in the insurrection, commenced before any of the king's justices or before the 15 days period of St John the Baptiste next coming (24 June 1383) to be commenced; that if they, against whom such suits be taken, or before the said period of 15 days shall be taken, come before judgement and and will thereof purge or acquit themselves, by three or four good and suitable men and not suspect, thereupon sworn before the justices where the plea shall be thereof pending, namely, that they came not willingly in the place alleged for the cause of any evil, nor did no harm, but solely by the compulsion of others; they shall be therefore received by the aforesaid justices and judges, and the purgation of this kind shall be made by the aforesaid witnesses; then they shall depart thereafter wholly quit. And they say that they are ready with three or four good and suitable men and not suspect to be purged or otherwise acquitted, namely they came not willingly in the place alleged for the cause of any evil nor did the cause do damage to the aforesaid Nicholas, but solely through compulsion by John Strawe, Walter Tiler and other insurgents. And they ask for judgement if the aforesaid Nicholas maintained his accusations against them etc. [paraphrase] Nicholas is prepared to hear the purgation of Walter and the others. Walter and the others (all named) present four good men, John atte Felde, Richard Stephen, Laurence Bysouthe and William Cheseman who say under oath that Walter and the others did not voluntarily attack Nicholas but were forced by Strawe, Tiler and other insurgents. Therefore, they should be acquitted. Nicholas declares that their defence is not valid and the Statute does not apply to them because they voluntarily kept Nicholas' belongings after the rising. Nicholas asks for judgement. [paraphrase] Walter and the others declare the Statute allows everyone to purge himself for all evils committed during the rising if the perpetrators have been forced to do so. A day for judgement is given to both parties.
