Text (English translation) | Bedfordshire. Robert Cook of East Hatley, Geoffrey Lepere, John Lucas de Chesterton, Robert Trumpe, John Skreyche, John Manwod, Thomas Roger of Arthyngtone, John Coo of Arthyngtone, and Simon atte Lane attached to answer Sir William Croyser on a plea that, together with Richard Brampton, John Goffe of Stapleford, John Brewys, Thomas Burtone, John Northerne, William Webbe of Arthyngtone, John Michael of Sutton, Walter Clement, William Juwel of Potton, John Clement, Robert Clogone, John Kirkeby of Sutton, John Robyn, John Wyse of Sutton, William Ropere of Meldreth and Walter Rous of Abington with force and arms they broke the close and houses of the said William at Wrestlingworth, and took and led away eight horses, eight oxen and sixty pigs of his found there, price 40m, and took and carried away goods and chattels of his found there to the value of £200, and inflicted other enormities on him to the grave damage of the same William Croyser and against the King's peace. And whence the same William Croyser complains through Richard Carltone, his attorney, that on 17 June 1381 the aforesaid Robert Cook, Robert Lepere, John Lucas, Robert Trumpe, John Skreyche, John Manwod, Thomas Rogere, John Coo and Simon, with force and arms, namely swords, bows and arrows, broke the close and houses of the said William Croyser at Wrestlingworth and took and led away eight horses, eight oxen and sixty pigs of his found there, and took and carried away goods and chattels of his found there, namely linen and woollen cloth, wood, bronze and brass vessels, wheat, barley, rye, beans, peas and oats, the doors, windows and other necessaries of the homes, as well as the timber from the aforesaid houses, namely the posts and beams, and other enormities to the grave damage and against the King's peace, whence he says that he suffered damages to the value of £100. And thereof he produces suit. And the aforesaid Robert Cook, Geoffrey, John Lucas, Robert Trumpe, John Creyche, John Manwod, Thomas Roger, John Coo and Simon appear in person and say that the aforesaid trespass, supposed by the account of the aforesaid William, was at the time of the rising up of rebels against our lord King and his loyal subjects, and separately they say that, according to the statute of the lord King enacted in his parliament held there at Westminster on Monday 23 February 1383, it is ruled and conceded that, if any person be implicated or impeached as a supporter of any trespasses in the same uprising, if he who was implicated or impeached thus himself provide three, four, or more, trustworthy men before the justices who plead likewise in their presence, he would be able to clear or excuse himself that he is not guilty of such a trespass or that he was forced and compelled to make such a trespass by the aforesaid rebels against his will. And they say one by one that they were forced and compelled by John Hauchache, the principal insurgent, traitor and evildoer, and also rebel, of the lord King, both in the aforesaid parts and in the county of Cambridgeshire at the above stated time, to go against their will with the same rebels as far as Wrestlingworth, where the aforesaid trespass is supposed to take place, and there, through injury and under threat of beheading and the burning of their houses and destruction of all their movables, and granted that they came there thus by coercion and against their will, they nevertheless perpetrated there no evil trespass without damage against the same William Croyser. And henceforth each of them is prepared to clear and to excuse himself by means of trustworthy men, according to the form of the aforesaid statute, and just as this court adjudged. Therefore, it is considered that each of them should clear and then excuse himself, according to the form of the aforesaid statute, and they should appear here in person, and with the trustworthy men, in the octave of Hilary 1385, to clear and then separately excuse themselves according to the form of the aforesaid statute, with the peril which would be incumbent. The same day is given to the aforesaid William Croyser. And hereupon John Spenser of Hungry Hatley, William Gosselyn, John Coulyngs and John Segen of the county of Cambridgeshire, mainprised the aforesaid Robert Cook, Geoffrey, John Lucas, Robert Trumpe, John Screyche, John Manwode, Thomas Roger, John Coo and Simon, to have them here at the aforesaid term. At which day both the aforesaid William Croyser appeared through his aforesaid attorney and the aforesaid Robert Cook, Geoffrey Lepere, John Lucas, Robert Trumpe, John Skreyche, John Manwode, Thomas Roger, John Coo and Simon atte Lane appeared in person. And hereupon each of the aforesaid Robert Cook, Geoffrey Lepere, John Lucas, Robert Trumpe, John Skreyche, John Manwod, Thomas Roger, John Coo and Simon atte Lane excused and cleared himself by means of four good and trustworthy men, that they are not guilty of the aforesaid trespass according to the form of the aforesaid statute. Therefore, it is considered that they should go hence without day and that the aforesaid William Croyser as to doctrine should take nothing by his writ but is in mercy for his false claim. |
