Ideo preceptum est vicecomiti quod venire faciat hic in crastino Purificacionis Beate Mare per iusticiarios xii etc per quos etc. Et qui nec etc. Ad recognoscendum etc. Quia tam etc. Et super hoc Richardus Merden Thomas Essex Iohannes Buntyng et Iohannes Markeby de London manuceperunt predictum Willelmum habendi corpus eius hic ad prefatum terminum per iusticiarios et sic de die in diem quousque iurata inde inter eos transierit et iudicium inde redditum fuerit videlicet quilibet eorum corpus pro corpore etc. Postea continuato inde processu inter partes predictas per iuratos positas autem eas in respectum hic usque ad hunc diem scilicet in octabis Sancti Michaelis nisi Iohannes Holt unius iusticiarius domini Regis de communi banco die Mercurio proximo post festum Sancti Iacobi Apostoli apud Henhowe prius venisserit. Et modo hic ad hunc diem etc venit predictus Radulphus per attornatum suum predictum. Et predictus Iohannes coram quo etc misit hic recordum suum in hec verba: Postea die et loco infracontentis cora Iohanne Holt uno iusticiario domini Regis de communi banco associato sibi Willelmo Thirnyng per formam statuti etc venit Radulphus de Walsham in propria persona sua. Et predictus Willelmus Wyndout infracontentis ibidem solempniter exactus non venit. Ideo iurata predicta capiatur versus eum per defaltam etc. Et super hoc iuratores exacti venerunt qui de assensu ipsius Radulphi ad ueritatem de infracontentis dicendis electi triati et iurati dicunt super sacramentum suum quod predictus Willelmus culpabilis est de transgressione vnde infra fuit mencio prout per breuem et narracionem predicta Radolphi supponitur ad dampnum ipsius Radolphi centum et quadraginta marcarum. Text (English translation) | Suffolk. William Wyndout attached to answer Ralph de Walsham on a plea that with force and arms he broke the close and certain chests of the said Ralph at Mildenhall and took and carried away goods and chattels found there to the value of 40m, and took and led away Elizabeth, daughter of Ralph de Walsham, his servant, being in the same, whereby the same Ralph lost the service of his servant aforesaid for a long time, and inflicted other enormities on him, to the grave damage of the said Ralph, and against the King's peace. And whence the same Ralph complains through Thomas Ewelle, his attorney, that on Friday 14 June 1381, the aforesaid William with force and arms, namely swords, bows and arrows, he broke the close and certain chests of the said Ralph at Mildenhall and took and carried away goods and chattels found there, namely bronze and wooden vessels, grain, malt, beans, peas and oats, and also linen and woollen cloth, and took and led away the aforesaid servant Elizabeth, being there, whereby the same Ralph lost the service of the servant for a long time, namely throughout the two years following the aforesaid Friday, and other enormities, to grave damage, and against the peace of the King. Whence he says that he suffered damages to the value of £100. And thereof he produces suit. And the aforesaid William appears in person and says that he is not guilty of the aforesaid trespass and places himself on the country. And the aforesaid Ralph likewise. Therefore, the sheriff is ordered to summon twelve jurors for the Wednesday 3 February 1384. And hereupon Richard Merden, Thomas Essex, John Buntyng and John Markeby de London mainprised the said William to appear at the aforesaid term and from day to day until judgement is rendered. Afterwards this was delayed until the octave of Michaelmas 1384, unless John Holt, one of the lord King's justices of the Common Bench, should appear at Henhowe before Wednesday 27 July. And presently here at this day the aforesaid Ralph appeared through his aforesaid attorney. And the aforesaid John, before whom he appeared, sent here his record in these words: Afterwards, on the day and at the place contained within, before John Holt, one of the lord King's justices of the Common Bench, associate of William Thyrning, according to the form of the statute, Ralph de Walsham appears in person. And the aforesaid William Wyndout named within, solemnly summoned, does not come. Therefore, let the aforesaid jury be taken against him by his default. And hereupon the jurors summoned came, who, from the agreement of the said Ralph, to the truth of that declared within, elected, tried, and sworn to this, say on their oath that the aforesaid William is guilty of the aforesaid trespass, exactly as supposed in the writ and account of the aforesaid Ralph, to the damage of the said Ralph of 140m. Therefore, it is considered that the aforesaid Ralph should recover damages to the 140m assessed from the aforesaid William. And the same William should be arrested. |
