Text (English translation) | Cambridgeshire. John Rote of Stoke, Robert Jannibe, shoemaker, James Bertram, John Whelwrighte, John Webbe, Michael Milksope, Richard Milksope of Stoke, Simon Meloun of Clare, William Praty, William Dagenel, draper, Robert Skymere, John Chatrys and John Praty attached to answer John Sibyle on a plea that together with John Panel of Ridgwell, Thomas Panel and Henry Burtone, with force and arms they broke the close and houses of the said John Sibile at Horseheath and took and carried away his goods and chattels found there to the value of £40, and inflicted other enormities on him, to the grave damage of John Sibile and against the King's peace. And whence the same John Sibile complains through his attorney John Payn that on Thursday 13 June 1381 the aforesaid John Rote, together with others, with force and arms, namely swords, sticks, bows and arrows broke the close and houses of the said John Sibyle at Horseheath and took and carried away his goods and chattels found there, namely wheat, barley, malt, peas and oats, necklaces, rings with gold and silver bound together, silver cups, mazers, silver spoons, choice linen and woollen cloth, basins, lavers, and other necessaries of the home, and inflicted other enormities on him, to the grave damage of the said John Sibile and against the King's peace, whence he says that he suffered damages to the value of £100. And thereof he produces suit. And the aforesaid John Rote and others appear in person and say that they are not guilty of the aforesaid trespass and place themselves on the country. And the aforesaid John Sibile likewise. Therefore, the sheriff is ordered to summon twelve jurors for the quindene of Trinity 1382. At this day the aforesaid jury was delayed until the quindene of Michaelmas next. And presently at this day the aforesaid John Sibyle appeared here in person as the aforesaid John Rote and all others through Thomas Maysham, their attorney. And the jurors likewise came, who, from agreement by all aforesaid, elected, tried, and sworn to this, say on their oath that the aforesaid John Rote, and all others who were otherwise found and sentenced, are guilty of the entire trespass aforesaid to the damage of the said John Sibyle of £70, except for regarding the carrying away of the aforesaid grain, and who, they say, they are not guilty of the carrying away of the aforesaid grain. Therefore, it is considered that the aforesaid John Sybile should recover damages to the £70 assessed from the aforesaid Rote, and all the others who recently appeared. And the same John Rote and all the others should be arrested. And the aforesaid John Sybile is in mercy for his false claim against those who are acquitted for the carrying off of the aforesaid grain. And hereupon the same John Sybile acknowledges himself unwilling to pursue the aforesaid John Panel of Ridgwell, Thomas Panel and Henry Burtone further regarding the aforesaid plea. Therefore, the same John Sibile should have execution regarding the aforesaid damages. The same John Sibile appears, through his aforesaid attorney, against the aforesaid John Panel, Thomas Panel and Henry Burtone on the aforesaid plea. And they did not come. Therefore, the sheriff was ordered to arrest them. And the sheriff reports that they cannot be found. Therefore, just as previously the sheriff is ordered to arrest them and produce them here at the aforesaid term. |
