Text (English translation)To our very good Lord the King and his noble council in this present parliament William Salesbury clerk shows that whereas the King Edward, the grandfather of the present King, whom God assoil, received by judgement through a writ of quare impedit before the King's justices of the bench the right of presentment to the prebend of Blewbury in the diocese of Salisbury in the possession of the Prior of the Hospital of St John in England, by force of which judgement the said William Salesbury clerk was instituted and installed by order and licence of the said King Edward and had peaceable possession until David Cal[verley] clerk by malice and false suggestion submitted that the said vacant prebend was at the disposal of the Apostolic See and purchased the provision of the said prebend in contempt of our Lord the King and undermining of the said judgement. Upon this, he pursued various processes and sentences against the said William and many others besides sergeants and the council of the king against the statute of Provisors and to the grave damage of the said William de Salesbery so that the said David by process begun under the said statute was arrested in the King's Bench and upon this made to respond concerning the said contempt and trespass both to our Lord the King as well as the said William and upon this was sent by order of the said court in the Marshalsea prison in order that he would have no excuse to pursue the said contempt and trespass whereupon certain persons requested that David should be released on bail on penalty of £1,000 for his good behaviour in order that a good accord could be made to settle this matter. Whereupon the said David with many malefactors supporting him seized that said William at the said prebend of Blewbery in Berkshire against the peace and ejected him from the said prebend and held him prisoner from county to county as far as Newcastle under Lyme in the county of Staffordshire and there detained the said William in prison threatening to kill him if he did not renounce his right to the said prebend and agreeing to do this the said William escaped out of their hands whereupon this matter being presented in the King's Bench the said David was arrested in the King's Bench and committed to the custody of the Marshal both for his first contempt and trespass as well as for this last contempt and trespass made while he was on the bail of £1,000 aforesaid. And upon this on the eve of the feast of Corpus Christi last past [12 June 1381] when Jacke Strawe and his fellow traitors arising against our lord the King burnt the prison of our Lord the King of the said Marshalsea, the said David who was then in that prison in Southwark by their assent and power was delivered and went with them and by their power enter the said prebend of Blewbury and there took various goods and chattels from the said William with the profits of the said prebend to the value of £200. Upon which the said William having shown this matter in the Chancery, the said William received letters patent under the Great Seal of the King to certain sergeants-at-arms to arrest David and reinstate William in possession. When the said sergeants went to Blewbury with the said William to put him in possession, the said David went there with a great force of the said rioters and threatened the said William in life and members and with great difficulty he escaped from their hands with his life in contempt of our lord the King and his letters patent and to the great damage and abasement of the said William. This is witnessed by Henry de Thorp sergeant of arms of our lord the King and William Spaygne who were present. For which he prays remedy as a work of charity and that the said David should be taken and put in prison until he renounces all that he has done in contempt of the King as the statute requires.
General Information[1381] Firmly datable by reference to CPR 1381-5, p. 75. The dispute over the prebend of Blewbury is outlined in Fasti Ecclesiae Anglicana, 1300-1451, Salisbury, p. 37.
