Text (English translation) | Hertfordshire. Peter Dayford is in mercy for multiple defaults. The same Peter attached to answer John Quenyld on a plea that, together with John Chaumpe of Ardeley and John Feysannt, with force and arms he burnt the goods and chattels of the said John Quenyld in his houses at Cottered, and also the aforesaid houses, and he took and carried away goods and chattels found in the same to the value of 40m, and inflicted other enormities on him, to the grave damage of the said John Quenyld, and against the King's peace. And whence the same John Quenyld complains in person that on Saturday 16 June 1381, with force and arms, namely swords, bows and arrows, the aforesaid Peter burnt goods and chattels, namely the wheat, barley, beans, peas, oats and the haystacks of the said John at Cottered, and also the houses aforesaid, and he took and carried away his goods and chattels, namely linen and woollen cloth, tablecloths, napkins, silver spoons, gold and silver brooches, cups, bronze, lead and wooden vessels and other necessaries of the home, and other enormities, to the grave damage, and against the peace, whence he says that he suffered damages to the value of £100. And thereof he produces suit. The aforesaid Peter appears through William Mekesburne, his attorney, and says that the aforesaid John should not maintain the aforesaid trespass against him, because he says that a certain John Coleman and other evildoers came, at the time of the uprising, to the house of the said Peter at Hertford, and they compelled him by harshness and coercion, as well as great injuries, against his will, without which no wrong without damage would have been done to the same John, and this he is prepared to defend against him and his suit, just as is contained in the statute enacted at Westminster on Monday 23 February 1383, namely that he come with three or four good and suitable men, not themselves suspected having been examined at this jury and by the justices. Therefore, it is considered that he pledge his law in the aforesaid form, pledges of law Stephen Boyford of London and William Mekesburghe, and he appear here with his law at the quindene of Easter 1384 to make his aforesaid law in the aforesaid form. At which day the aforesaid Peter appears in person. And the aforesaid John Quenyld, solemnly summoned, does not come. Therefore, he and his pledges are at mercy. And the aforesaid Peter may go without day. Essex. Thomas Broun in mercy for many defaults. The same Thomas was attached to answer John Gildesburgh, knight, in his plea that he together with Nicholas Cheynel of Eastwood, Lionel Underwode, Lionel Hasele, Thomas Partrich, Walter Fullere of Eastwood, Walter Parkete (or Parkere?) of Thundersley, William atte Slouth of Hawkwell, William Dounham, William Crabbe, Edmund Wheler of Hawkwell, William Gilmyn of Rainham, Hervy Clerk of Romford, William Pecok of High Easter, Walter Stistede, Walter Cook of Lesnes(?), William de Ossmere Boxene(?) et John Spaigne de Greenwich(?) with force and arms broke the close and the houses of the said John Gildesburgh at Wennington, South Fambridge and High Easter and took and carried away goods and chattels found there worth £40 and they committed other enormities to the great damage of the said John Gildesburgh and against the peace of the king. And therefore the same John Gildesburgh by John Giffard, his attorney, impleaded that the said Thomas together etc. on Tuesday after the feast of Trinity 4 Richard II (11 June 1381) with force and arms, namely swords, bows and arrows, broke into the close and the houses of the said John Gildesburgh at Wennington, South Fambridge and High Easter and took and carried away his goods and chattels, namely linen and woollen cloths, brass and wooden vessels and other domestic utensils found there worth etc. and other enormities etc. to the great damage etc. And against the peace etc. Therefore he said he suffered loss and had damage worth 100 marks. And therefore he brings this suit etc. And the said Thomas Broun by William Godhawe, his attorney, came. And he defends the force and injury whenever (it behoves him) etc. And he said that he is not guilty of the aforesaid trespasses ... And he places himself upon the country. And the aforesaid John similarly. Therefore the sheriff is ordered to make them appear at Easter in quindene. xii (jurors) etc. in which etc. and because not etc. to investigate by jury etc. ... |
