Text (English translation) | It was found in the roll of particulars of account of Ralph Wykes, lately the king's escheator in the counties of Cambridgeshire and Huntingdonshire, that the same escheator did not answer for some revenues of one messuage with pertinences in Lynton that belonged to John Peper, a traitor to the lord King by rising up against his allegience on 13 June, 4 Rich. II [1381]. For the 5s. it is valued per annum, the said late escheator is made answerable for 2s. 7d. of the revenues of the aforesaid messuage from the aforesaid 13 June until 15 December next. Said late [escheater] was obliged to seize the aforesaid messuage into the King's hand, and the revenues that will henceforth arise. At the inquisition held in the presence of the aforesaid late escheator at Lynton [Linton] in said county of Cambridgeshire on the nearest Thursday before the feast of Saint Laurence, 5 Rich. II [8 August 1381], it was found that it is in the hands of John de Sleford, parson of the church of Baseham [Balsham, Camb.], in mortgage, on account of the failure of a payment of 5m. Recently, at the quindene of Trinity [1383], the aforesaid John Sleford, and indeed Thomas Fodryngay, came here before the Barons [of the Exchequer] by means of their attorney, John Everdon. They say that a long while before said 13 June [1381], John Peper enfeoffed the aforesaid John de Sleford and Thomas of all lands and tenements, with their pertinances, in Lynton Magna and Lynton Parva, to have and to hold, for themselves and their heirs. In fact, that he handed over possession [seisin] of the aforesaid messuage in Lynton Magna to the same John and Thomas. He showed to the court a charter under the name of the said John Peper of Lynton Magna, prepared with these words: "Know [men] present and future that I, John Peper of Lynton Magna, have given, granted and by this my present charter confirmed to John Sleford, clerk, and Thomas Fodryngay, etc... ...witnesses Robert Hauchath, Henry Martyn, Michael Cok, William Pakere, Robert Crisp, Henry Smyth et al. given at Lynton Magna 14 January, 3 Rich. II [1380]." They say that the aforesaid charter was made by the aforesaid John Peper and was sealed on the day and at the place contained therein. That, by virtue of of aforesaid feoffment, they themselves took possession of the aforesaid messuage, and continued their estate thenceforth until they themselves were removed by the aforesaid escheator by virtue of the aforesaid inquisition, on such terms that the aforesaid John Peper to some extent possessed the same messuage on the aforesaid 13 June, even ever thereafter. John de Sleford and Thomas judiciously seek the recovery of the aforesaid messuage with the revenues from the time it was seized. It is said on behalf of the King that the charter aforesaid was not made by the aforesaid John Pyper nor sealed on the day and at the place contained therein. And it is requested on behalf of the lord King that this be investigated by means of a jury. And the aforesaid John Sleford and Thomas request similarly. It was commanded to the sheriff of Cambridgeshire that, at the quindene of Saint John the Baptist, he put together a quorum of persons of Lynton Magna etc. The same day is given for the aforesaid John Sleford and Thomas etc, and they came through their attorney. The sheriff returned the writ with a list of the jurors names. They themselves did not come, and it is agreed that John de Denton, clerk of pleas here in the exchequer, is assigned by means of a commission to make inquisition concerning the things mentioned here and thenceforth hold this inquisition at the quindene of Michaelmas and it is commanded that the sheriff distrain the aforesaid jurors regarding the lands etc. [dorse] The aforesaid John de Sleford and Thomas Fodryngay came by means of their attorney to the inquisition into all the things mentioned here in the prescence of John de Denton, at Cambridge on Saturday before Michaelmas, 7 Rich. II [26 September 1383]. By oath of Robert Haunchach, Robert Crips, and all of the other jurors whose names are noted in the inquisition aforesaid, the jurors declare, upon their oaths, that John Peper of Lynton Magna enfeoffed the aforesaid John de Sleford and Thomas through his charter and handed over the possession of the aforesaid messuage. They say that the aforesaid charter was made by the aforesaid John Pepir and was sealed on the day, and at the place contained therein. That, because the aforesaid John Peper had nothing in the aforesaid messuage on the aforesaid 13 June [1381], they should be exonerated and that the hand of the King should be moved from that messuage, and that messuage be handed over to the aforesaid John de Sleford et Thomas Fodryngay, together with the revenues from there for half the time it was seized under the inquisition's authority, and any other things mentioned, save from the opportunity of the king, if at another time henceforth he might wish to speak. |
